18+ Entry Disclaimer

ChatUp AI contains adult-oriented content and is intended for users aged 18 and older. By accessing or using this Service, you confirm that you are at least 18 years old or have reached the age of majority in your jurisdiction. If you are under 18 years old, you must immediately leave this website and refrain from using the Service. Continuing to use ChatUp AI signifies your acceptance of these conditions and responsibility for your use.

Geographic Restriction – Prohibited Jurisdictions (Mainland China, Hong Kong SAR, North Korea, etc.)

The Service is strictly prohibited from being accessed or used in Mainland China and the Hong Kong Special Administrative Region (SAR), as well as in jurisdictions where adult (18+) content is banned by law, including but not limited to Iran, North Korea, Afghanistan, and Pakistan. You agree you are solely responsible for and assume all risks associated with any access or use of the Service from Mainland China or Hong Kong in violation of these Terms, including compliance with local laws and any resulting consequences or liabilities. ChatUp AI expressly disclaims all liability arising from or related to any prohibited use of the Service from Mainland China or Hong Kong. If located in Mainland China or Hong Kong, you must cease using the Service immediately.

AI-Generated Content & Output Disclaimer

We strictly prohibit the intentional prompting, generation, output, sharing, or uploading of AI-generated child pornography, non-consensual deepfakes, or any exploitative and harmful content. We employ robust automated safety filters to prevent the output of such materials. Any violation of this policy, including attempts to bypass our safety mechanisms, will result in immediate account termination, and potential legal action will be pursued. All images, text, or other content generated using our AI tools are purely fictional and do not depict real individuals, living or deceased. The characters portrayed in AI-generated images are intended to be over the age of 18, and we make every effort to ensure that content complies with applicable legal standards. We do not condone, tolerate, or permit the creation, output, or distribution of any unlawful, harmful, abusive, or offensive content.

1. Eligibility

You must be at least 18 years old to use ChatUp AI. By using the Service, you represent and warrant that you meet this requirement. If you are not yet 18, you are prohibited from accessing or using the Service.

2. Account Registration

You are responsible for safeguarding your account credentials, including your password, and for all activities conducted under your account. You should not share your account information with third parties. If you believe your account has been compromised, please notify us immediately.

3. Prohibited Uses

The following uses of the Service are strictly prohibited:

• Prompt, generate, output, share, or upload illegal, harmful, hateful, or abusive content.
• Generate or distribute child pornography, exploitative content, extreme violence, or content that promotes illegal activities.
• Attempt to bypass, manipulate, or disable our safety filters (jailbreaking) to generate prohibited or harmful outputs.
• Infringe upon intellectual property rights.
• Violate any applicable laws, regulations, or third-party rights.
• Engage in activities that defame, harass, threaten, or harm others.

Note: All user-uploaded content functionalities, including image-to-video and face swap, have been permanently removed as part of our compliance update.

4. Subscription Services

Subscriptions to ChatUp AI are subject to recurring payments, unless otherwise specified. You may cancel your subscription at any time through your account settings.

5. Refund Policy

Refunds for any subscription or purchase are subject to our Refund Policy. Please review the full Refund Policy here for details on the conditions under which refunds may be issued.

6. Account Termination

We reserve the right to suspend or terminate accounts at our discretion, including but not limited to violations of these Terms, attempts to generate harmful outputs, or any activities that harm the integrity, safety, or reputation of the Service. Any violation of our policies will lead to immediate action, including potential legal proceedings.

7. Content Removal Policy

While we support our users’ creative freedom to explore adult themes within private AI chats, we strictly prohibit any content that violates legal regulations. Content or outputs involving minors, non-consensual acts, bestiality, hate speech, self-harm, or other unlawful activities will be immediately blocked or removed. As of Feb 2025, we have disabled all user-uploaded image/video features and removed access to any private albums or galleries. We have implemented a clear and efficient process for reviewing and removing content that violates these Terms. 8. Intellectual Property Rights

ChatUp AI retains all intellectual property rights to the Service, including the software, algorithms, and any proprietary technology used to generate AI content. Users retain ownership of the content they generate but grant ChatUp AI a limited, non-exclusive license to use, display, and share public content solely for service improvements, safety filtering, and related purposes.

9. Indemnification

You agree to indemnify and hold ChatUp AI, its affiliates, officers, employees, and agents harmless from any claims, damages, or legal costs arising from your use of the Service or violation of these Terms. This includes but is not limited to any infringement of third-party rights, generation of harmful outputs, or illegal activities conducted using the Service.

10. Limitation of Liability

ChatUp AI is not liable for any indirect, consequential, incidental, special, or punitive damages arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the Service during the six (6) months prior to the event that gave rise to the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved in the courts located in Ireland.

12. Changes to Terms

We reserve the right to update or amend these Terms at any time. All changes will be posted on this page, and the updated Terms will become effective immediately upon posting. By continuing to use the Service after any changes, you agree to be bound by the revised Terms.
